Ernie AI Driving Instructor is operated by Ernie AI, a trading name of Ernest & Co Accountants Ltd, registered in England and Wales.

2. What Data We Collect

We collect the following categories of personal data:

Account data: your name and email address when you register
Usage data: quiz scores, lessons completed, and AI chat messages
Technical data: device type, browser type, and app version
Communications: messages you send to the Ernie AI tutor

We do not collect sensitive personal data such as health information, financial data, or government identifiers.

3. How We Use Your Data

We use your personal data for the following purposes:

To provide and personalise the App experience (legal basis: contract)
To save your progress, quiz scores, and chat history (legal basis: contract)
To improve the App and fix technical issues (legal basis: legitimate interests)
To send you important service updates (legal basis: contract)
To comply with legal obligations (legal basis: legal obligation)

4. AI Tutor & Third-Party Processing

The Ernie AI Tutor is powered by Anthropic's Claude AI. When you send a message to the AI tutor, your message is processed by Anthropic's API. Anthropic acts as a data processor on our behalf. Messages are used solely to generate responses and are not used to train Anthropic's models.

Please do not include personal sensitive information (such as your full address, financial details, or medical information) in AI tutor messages.

5. Data Storage & Security

Your data is stored securely using Supabase, a cloud database provider. Data is stored on servers within the European Economic Area (EEA). We implement appropriate technical and organisational measures to protect your data against unauthorised access, loss, or disclosure.

6. Data Retention

Account data: retained while your account is active and for 12 months after deletion
Quiz scores and lesson progress: retained for 24 months
AI chat messages: retained for 12 months

You can request deletion of your data at any time (see Section 8).

7. Sharing Your Data

We do not sell your personal data. We share data only with:

Supabase (database and authentication provider)
Anthropic (AI processing for the tutor feature only)
Law enforcement or regulatory authorities where legally required

8. Your Rights Under UK GDPR

As a UK resident, you have the following rights:

Right of access: request a copy of your personal data
Right to rectification: correct inaccurate data
Right to erasure: request deletion of your data
Right to restriction: limit how we use your data
Right to portability: receive your data in a machine-readable format
Right to object: object to processing based on legitimate interests

9. Cookies

The App uses essential cookies only for authentication (keeping you logged in). We do not use advertising or tracking cookies. No cookie consent banner is required for essential cookies under UK PECR.

10. Children

The App is intended for users aged 15 years and 9 months and over (the minimum age to apply for a UK provisional driving licence). We do not knowingly collect data from children under 13. If you believe a child has provided us with personal data, please contact us immediately.

10a. Age Rating

This app is rated 4+ (Everyone) on the Apple App Store and rated Everyone on Google Play. While the app contains no objectionable content, the driving education content is specifically designed for users aged 15 years and 9 months and over — the minimum age to apply for a UK provisional driving licence. Users under 13 must have parental consent to create an account.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes via the App or by email. The date at the top of this page shows when it was last updated.
