3. Important Disclaimer — Not a Substitute for Professional Instruction

THE APP IS FOR EDUCATIONAL PURPOSES ONLY.

• The App does not replace professional driving instruction from a DVSA-registered driving instructor
• The App does not guarantee you will pass your theory or practical driving test
• The mock tests in the App are not official DVSA tests and may differ from the actual test
• Always follow the advice of a qualified instructor and the official DVSA materials
• Do not rely solely on this App when making decisions about road safety

4. AI Tutor Disclaimer

The Ernie AI Tutor is powered by artificial intelligence and may occasionally produce inaccurate or incomplete information. You should:

• Always verify AI tutor responses against the official Highway Code (gov.uk/highway-code)
• Not treat AI responses as legal advice or official DVSA guidance
• Report any inaccurate responses to us at support@ernieaidriving.co.uk

We are not liable for any decisions made based solely on AI tutor responses.

5. Eligibility

You must be at least 13 years old to create an account. By registering, you confirm you meet this requirement. The driving content within the App is most relevant to users aged 15 years and 9 months and over.

6. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You must not create accounts using false identity information
• Notify us immediately at support@ernieaidriving.co.uk if you suspect unauthorised account access

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, copy, or reproduce App content commercially
• Upload or transmit harmful, offensive, or illegal content via the AI tutor
• Attempt to circumvent any security or access controls
• Use the App in any way that could damage, disable, or impair its functioning

8. Intellectual Property

All content within the App, including Highway Code summaries, quiz questions, design, and branding, is owned by Ernie AI, a trading name of Ernest & Co Accountants Ltd or licensed to us. The Ernie AI brand and logo are proprietary.

UK Highway Code content is based on Crown Copyright material available under the Open Government Licence v3.0.

9. Subscription & Payments

The App currently offers free access to core features. If premium features are introduced, pricing will be displayed clearly before purchase. Payments are processed securely via Stripe. UK consumer rights apply to all purchases.

10. Limitation of Liability

To the maximum extent permitted by English law, Ernie AI, a trading name of Ernest & Co Accountants Ltd shall not be liable for:

• Any failure of a user to pass their driving theory or practical test
• Any inaccuracies in AI tutor responses
• Any loss or damage arising from reliance on App content
• Any indirect, consequential, or incidental loss

Nothing in these terms limits our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

11. Availability

We aim to keep the App available at all times but do not guarantee uninterrupted access. We may suspend the App for maintenance or updates. We will provide reasonable notice where possible.

12. Changes to These Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes via the App or email.

13. Termination

We reserve the right to suspend or terminate accounts that breach these Terms. You may delete your account at any time via the Settings screen in the App.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
